MUDA Terms of Use

You must be at least 13 years old to use MUDA. If you are under 18, you must have permission from a parent or legal guardian.

To use certain features, you must create an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

MUDA provides tools that allow users to create AI-generated avatars based on their uploaded images, try on clothing virtually, create outfits, and receive personalized recommendations. The app may also allow users to share avatars and outfits publicly.

You retain ownership of any content you upload, including photos and clothing images. By uploading content, you grant MUDA a non-exclusive, worldwide license to use, process, and display that content solely for the purpose of operating and improving the service.

You represent that you have the necessary rights to upload and use such content and that it does not violate any laws or third-party rights.

You agree not to upload or share content that is unlawful, harmful, or inappropriate. This includes, but is not limited to, nudity, explicit material, or content that infringes intellectual property rights. We reserve the right to remove content and suspend or terminate accounts that violate these Terms.

The application utilizes artificial intelligence to generate avatars and related content. Such outputs may not be accurate or representative in all cases. You acknowledge that use of such outputs is at your own risk, and MUDA disclaims liability for any inaccuracies.

Certain features of the application are offered on a subscription basis. By subscribing, you agree to pay all applicable fees in accordance with the pricing and billing terms presented to you at the time of purchase.

Payments are processed through the applicable app store provider, such as Apple, and are subject to that provider's terms and conditions. Subscriptions will automatically renew at the end of each billing period unless canceled by you in accordance with the app store's policies.

All subscription fees are non-refundable, except where required by applicable law or the policies of the relevant app store provider. You acknowledge that any billing disputes, refund requests, or payment issues must be directed to the app store provider through which the purchase was made.

If a payment is declined, reversed, or not successfully completed for any reason, we reserve the right to suspend or terminate your access to the subscription-based features of the application until payment is received. Continued failure to fulfill payment obligations may result in the termination of your account and access to the services.

The application may provide links to third-party websites for the purchase of products. Any transactions conducted on such websites are solely between you and the relevant third party. MUDA assumes no responsibility for such transactions.

Subject to your compliance with these Terms, MUDA grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the application for your personal, non-commercial purposes.

This license permits you to use the features of the application, including the creation of AI-generated avatars and virtual outfits, solely for your own personal use. You are permitted to use and share AI-generated avatars created through the application for personal, non-commercial purposes, including on social media platforms, provided such use does not violate applicable laws or the rights of third parties.

You may not use the application or any AI-generated content for commercial purposes without prior written consent from MUDA. Prohibited commercial uses include, but are not limited to, selling, licensing, sublicensing, distributing for profit, using in advertising, marketing, promotional campaigns, or incorporating such content into products or services offered for sale.

You may not resell, redistribute, or otherwise commercially exploit any AI-generated avatars or outputs created through the application. You further agree not to use the application or its outputs in a manner that competes with MUDA or attempts to replicate its functionality.

Except as expressly permitted in these Terms, you may not copy, reproduce, modify, distribute, sell, lease, sublicense, reverse engineer, or otherwise exploit any part of the application or its underlying technology, including any AI models or systems.

All rights not expressly granted to you under these Terms are reserved by MUDA.

All intellectual property rights in the application, including its software, design, and branding, are owned by or licensed to MUDA. No rights are granted to you other than those expressly set forth in these Terms.

We reserve the right to suspend or terminate your access to the application at any time, including in cases of violation of these Terms. You may discontinue use of the application and delete your account at any time.

The application is provided on an "as is" and "as available" basis, without warranties of any kind. To the maximum extent permitted by law, MUDA shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the application.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands.
